No lo se a ciencia cierta, pero no me extrañaría nada que este material no tuviera copyright. Lo digo porque en mis escasos conocimientos de schranz y la gente que lo produce, se pasan los derechos por el forro bastante, regalan su música a cualquiera y se la pica bastante en general todo.

Porque supongo que si MeRiNo cuelga eso será porque a su vez lo encontró por ahí, o sea que ya estuvo colgado en otra parte, y probablemente si seguimos tirando del hilo para ver quién nació primero, si la gallina o el huevo, esos archivos los hayan colgado los propios productores.

La verdad, es que este tema hace tiempo daría para montar otro post, pero gracias a la UE ya no es así.

El tema de compartir archivos esta totalmente permitido excepto que exista animo de lucro. Mientras no se demuestre que hay animo de lucro, no hay ningún problema con el copyright.

Por dar ejemplos sobre el tema, os dejo unos enlaces sobre la famosa enmienda numero 13 que salió el año pasado en la UE.

El Parlamento Europeo ha votado en su sesión de hoy, 25 de abril, la propuesta modificada de Directiva del Parlamento Europeo y del Consejo relativa a las medidas penales destinadas a garantizar el respeto de los derechos de propiedad intelectual.

La Directiva establece finalmente en su artículo 3 que los Estados miembros velarán por calificar de infracción penal toda infracción intencional de un derecho de propiedad intelectual cometida a una escala comercial, así como la complicidad y la instigación a dicha infracción. Según el artículo 4, dichas infracciones deberán ser castigadas con penas privativas de libertad, multas y decomiso del objeto, los instrumentos y los productos procedentes de las infracciones.

La nueva Directiva impone en la práctica a los estados miembros la obligación de adaptar sus legislaciones a lo dispuesto en la misma. Se sitúa así en el punto de mira penal a los portales P2P que sin contar con la autorización de los titulares de derechos de autor obtengan beneficios comerciales. Ello no obstante, y en virtud de la enmienda número 13, el artículo 2 de la Directiva excluye la punibilidad de los actos efectuados por usuarios privados con fines personales y no lucrativos.

Si os fijais los enlaces vienen de paginas italianas la mayoria y yo lo cogi de una española osea que por lo menos hay 2 manos x encima. Yo entro x foros de alemania y paises del este y en todos tienen temas sueltos sin ningun problemaa!!! Daros cuenta que los artistas suelen ser de alli y no tienen problemas, no creo yo que vengan a reclamar aqui a españa, solo es una aportacion.

Si, existiría un problema. Por ejemplo, el cierre de ciertas páginas dedicadas al warez en general, vino motivado en gran parte por los banners publicitados en ellas. Aquí si se puede demostrar animo de lucro y claro, a continuación se aplicaría el cierre del site.

La verdad es que por temas de animo de lucro, exclusivamente se buscan a los sites que comentaba arriba, en los foros como este donde la cantidad de gente es considerablemente más reducida, el único problema que se podría tener es con agencias o con los propios artistas, pero no más.

Por ejemplo, un foro sin animo de lucro que ofrecía enlaces exclusivamente de vinilos, terminó por ceder a presiones de agencias y de los propios artistas dado a las peticiones de tenían de retirar los enlaces de sus producciones. Dicho foro terminó filtrando el acceso al foro con cuentas enviadas por el admin para cada usuario.

Podría decir que aquí no sucedería este problema, dado que un usuario que busque archivos con copyright en este foro, los encontrará de manera muy puntual. Y la verdad, no se va a parar en un site que tiene un enlace, podrá pararse donde se ofrece por ejemplo todas sus producciones al completo, como el ejemplo de foro que cité antes.

El tema de censurar o no archivos con copyright queda totalmente en manos de la administración, pero personalmente opino que aquí no habría problemas dado que como he dicho antes, se realiza de manera muy escasa.

La mayoria de estos temas estan editados en vinilo asi que...
